GavelWhen it comes to a speeding ticket defense, some things work, and others don’t. Here is a list of the common speeding ticket defenses, so you’ll know which ones to use during your next stop.

Speeding Ticket Defense – These Work

1) Traveling at the speed of traffic around me – necessity of safety.

This one actually works if you can show that by slowing down you would have created an unsafe situation due to everyone traveling at a high rate of speed around you. In this situation the police officer tries to stop the “fastest of the speeders”, so this could be you but it’s still worth a try.

2) Improper Posting of Speed Limit

If the speed limit is not properly posted, or obstructed from view this can be used in a defense to some degree of success. However all roads have an implied maximum, which you are supposed to know (rural roads 55mph, etc.). If you are way over that implied limit you may be out of luck – but if you’re close, and you couldn’t see the posted limit, this defense will work.

3) Improper Use of Radar

You can establish that the police did not properly use the radar when pulling you over for a stop. Proper use includes maintenance of the device, and maximum distance the device can get an accurate reading. This defense will take some work on your part, but if the radar was not used properly your ticket will be dismissed.

Speeding Ticket Defense – These Don’t Work

I’m just going to lump all these together in a bullet point for you. None will work, and actually some will give you a better chance of GETTING a ticket instead of getting out of one.

  • Any excuse that involves how busy, late, needed somewhere else you are will fall of deaf ears.
  • “Well everyone else was doing it!” – “Yeah, but I stopped you!”
  • This car is new to me, I didn’t know I was going that fast
  • My car doesn’t go as fast as you said I was going
  • I had my cruise control set, I couldn’t have been speeding
  • I gotta’ go to the bathroom!
